Hackers Just Stole Over 3 Million Social Security Numbers

If you've filed tax returns in South Carolina sometime since 1998, you might be in a little bit of hot water. An unidentified, foreign hacker has gotten into the state's Department of Revenue, pilfering around 3.6 social security numbers, and 387,000 credit and debit card numbers. In other words, no small haul. More »

CSN: Sandoval now among World Series legends

BOX SCORE

SAN FRANCISCO ? Just a few seconds before the first pitch of every game, Pablo Sandoval writes something in the dirt behind third base, he swipes it away with a brush of his hand, then he flings a cloud of red dirt in the air.

Shortstop Brandon Crawford knows the ritual well. He?s never asked about it. Neither has left fielder Gregor Blanco or second baseman Marco Scutaro.

?Man, he?s got so much ... stuff,? Scutaro said. ?He is doing something all the time.?

What Sandoval did in Game 1 of the World Series Wednesday night was something transformative, something historic and maybe a bit mystical. He wrote his name alongside Babe Ruth, Reggie Jackson and Albert Pujols -- heavy hitters, all -- as the only players in history to hit three home runs in a World Series game.

[RELATED: Sandoval joins rare list]

It cannot, will not be swiped away.

?Man, I still can't believe it,? said Sandoval, after his haymakers knocked out Justin Verlander in the Giants? tone-setting, 8-3 victory at AT&T Park. ?I'm enjoying this World Series. I'm enjoying all my moments.? You never know when it's going to happen again.?It means a lot for my family, my friends, my teammates. They all pull together to be here.?

Sandoval did not have these moments two years ago. He went from starting third baseman to chief towel waver, untrusted to pick up a ground ball because he had gotten too heavy. He was out of breath after taking a half-dozen grounders. Giants manager Bruce Bochy pulled the plug after Game 2 of that NL Division Series against Atlanta, moving Juan Uribe to third base and putting a forgotten, injury-marred veteran, Edgar Renteria, at shortstop.

That move worked out pretty okay. Renteria became the only World Series MVP in Giants history, after all.

Now Sandoval is the leader in the clubhouse for that honor. He homered to center off a searing fastball from Justin Verlander in the first inning, shocked the Tigers ace by taking an outside fastball the opposite way for a two-run shot in the third, then backspun a slider from Al Alburquerque over the center field wall in the fifth to become the first player in World Series history to homer in each of his first three at-bats in Game 1.

A single in his final at-bat completed a 4-for-4 game and his 13 total bases stands alone in second place, behind Pujols (14, on three homers and a double) for the most in a World Series game.

?He killed the whole mood,? joked left-hander Jeremy Affeldt. ?I mean, if you?re going to hit three home runs, you don?t hit the single fourth.?

Sandoval already looked to be locking in this postseason. He hit three homers in the first two rounds, and in the Giants? six elimination victories, he was 10-for-24 (.417) with two doubles, two home runs and five RBIs.

Sandoval had produced when the Giants most needed him. And against Verlander, a pitcher who was more terminator than man, Sandoval picked him up and flung him into a vat of molten steel.

?That?s the most amazing thing,? Giants pinch hitter Aubrey Huff said. ?You?re talking about a guy who?s the best on the planet right now. He took a pitch up and in, hard, and hit it out to center. I mean, how did he hit it? I can see how you?d get lucky and pull it, but to dead center? It?s hard to do that. I don?t know many guys in the league who can hit all off that. The first one I think of is maybe Barry Bonds in his heyday.

"I?m astonished, really. We all were.?

Not even Bonds hit three home runs in a game at AT&T Park. It hadn?t been done since the very first regular-season game here, 13 years ago, when the Dodgers? Kevin Elster parked a trio and everyone assumed the little waterfront stadium would play like a bandbox.

Well, that didn?t happen. In fact, the Giants hit just 31 home runs in 81 home games all season -- far and away the fewest by a home team in the major leagues. No Giant had hit three home runs at home since Bonds in 1994, at Candlestick Park.

?Barry never did it? Now that?s impressive,? Giants hitting coach Hensley ?Bam Bam? Meulens said. ?This is not a home run park, but it was warmer today than usual.?

With the 5 p.m. start, the early innings are usually the time when the Giants take batting practice before a night game. The ball always carries better before the temperatures drop. And Verlander was providing power with his upper-90s fastball.

Sandoval managed to backspin pitches off the barrel, and physics did the rest -- even if Verlander, wow-face and all, couldn?t quite believe it.

?It was extremely impressive,? Verlander said. ?I wish I hadn't contributed.?

Sandoval?s home run in the first inning came on an 0-2 pitch that Verlander tried to run above Sandoval?s hands. He didn?t get it high enough. It was just the fourth home run Verlander had allowed on an 0-2 pitch in his career; he hadn?t given one up all season.

Verlander entered with a 3-0 record, a 0.74 ERA in three postseason starts and an unbeatable air. Two years ago, the Texas Rangers? Cliff Lee had that same aura, along with a 3-0 record and 0.75 ERA in three postseason starts.

The Giants won Game 1 then, and they won it now.

?This was a big hyped game with Justin, probably a lot of pressure on him,? Tigers manager Jim Leyland said. ?But I don't think it had anything to do with the pressure. His fastball command was not good, he got out of sync, he got on fast forward.?He just did not pitch well tonight, it's that simple.

?But I go back, I want to start by giving the Giant hitters credit. I would not take anything away from them.?

Especially Sandoval.

?He?s an outstanding hitter, obviously, and he just had one of those nights where anything we threw, he hit,? Leyland said. ?I think you certainly tip your hat to what Sandoval did tonight.?You can't sit up here and say what he did tonight was a fluke. I mean, it was unbelievable. The guy had one of those unbelievable World Series nights that they'll be talking about for years.?So I tip my hat to him.?

Sandoval hit just 12 home runs in a regular season interrupted by injuries. He missed six weeks with a fractured hamate bone in his left hand. It?s a boo-boo that a player can only have once -- unless you are a switch hitter, and you break the other hand. It was Sandoval?s misfortune, and his penchant for resting the meaty part of his palm on the barrel, that led to hamate fractures in each of the past two seasons.

Then there was the hamstring injury that sent him to the DL after the All-Star break, when he did the splits while receiving a throw at first base.

It was frustrating, disheartening. But not more than 2010, when his issue wasn?t injury but a perceived lack of commitment. He didn?t start any of the three postseason series clinchers, and his World Series experience consisted of three hitless at-bats as the DH in Game 3.

?He didn?t play in the four most important games of the year,? Meulens said. ?When he didn?t play in the World Series, he said, 'That?s not going to happen again.'?

Sandoval is heavier than last season, but better conditioned than before. In a sense, though, he?s never been bigger.

?He?s skinny for me right now,? said Meulens, eliciting laughs.

Said Giants manager Bruce Bochy: ?Well, I'm happy for him. I'm sure he looks back at that time, that experience he had, and I'm sure he wasn't too happy with how it went there in 2010. He looks very determined to show that not just us, everybody, what a great talent he is.

?We've always thought a lot of Pablo, but at that time we had to make a change.? But we need him. I think the time from his surgery, he's gotten stronger the last month and is swinging the bat the way we know he can.?

But three home runs in a World Series game? The frenzied dugout reaction said it all.

?The second and third one, I think it was more shock that he hit another one,? shortstop Brandon Crawford said. ?So each time it seemed to build and build. But he?ll hit a slider off his front foot and put it in the water. So nothing he does surprises me.?

Buster Posey had the best view of anyone from the on-deck circle.

?Just the other day I was telling somebody I couldn?t believe it?d been done three times in the World Series,? Posey said. ?You look up and 24 hours later, I was right there to see it. I had a great look at it.?

And what did Posey see?

?Well, I looked in the dugout to see all their faces, and I was watching Pablo enjoy the moment, taking in his reaction and his expression,? Posey said. ?It was great. I mean, Pablo?s always happy. But he was really, really happy.?

Meulens was most happy about the second homer, on a Verlander pitch away after Sandoval didn?t bite on two change-ups in the dirt.

?He?s got an uncanny ability to hit the ball in all nine quadrants of the zone,? Meulens said. ?The ball down in the zone is the one he hits the hardest, the one we want him to focus on. But when he?s locked in, he can hit anything. That was as far down and away as you can go and Pablo stayed on it.?

Sandoval cracked his bat on a foul ball during his third at-bat. So he retired that one and picked up a new one. He used the new bat to take a right turn on Alburquerque. The Hall of Fame gladly took possession of the broken one, which he used to hit his two homers off Verlander.

?Yeah, man.?I use that bat all my postseason,? said Sandoval, who usually employs more bats than the Carlsbad Caverns. ?I don't get too much superstition.?There's more bats in there to swing. It's not the bat. It's you.

?It's everything you've got inside you.?

Summary: A Dutch filmmaker records the lives of three families, including one he stayed with as an exchange student. In one household, the dad works and the mom stays at home with their kids; in another, a gay couple experiences first-time fatherhood with the Vietnamese child they just adopted; and in the third home a 60-year old man becomes an instant father when he marries a thirtysomething Latina mother. Shot documentary-style. Modern Family won six Emmy Awards, including the one for Outstanding Comedy Series. It also brought home a Peabody Award, Writers Guild Award, Directors Guilds Award and Television Critics Award.
Modern Family Season 4 Episode 4 Summary: Luke wants to quit magic and Phil just can?t seem to accept it. Meanwhile, one of Gloria?s new pregnancy symptoms is snoring and she?s keeping the whole house awake, forcing Jay to take desperate measures; and Mitch and Cam?s household dynamic is put to the test when they decide to swap duties ? Mitch staying at home with Lily while Cam goes off to work at his new job as the music teacher at Luke and Manny?s school.

Schooled? is the first, and funniest, of the two episodes tonight, as Lily (Aubrey Anderson-Emmons) gets her hair pulled by a boy on her first day of kindergarten, and Cam (Eric Stonestreet) overreacts by picking up the boy, pressing him up against the swing set, and giving him a very stern warning about touching his daughter. This leads to the boy?s parents, a lesbian couple, being called in to meet with Cam and Mitchell (Jesse Tyler Ferguson). In the episode?s best sight gag, Cam and Mitchell explain (to the camera) why gay men and gay women don?t get along, by making a Venn diagram with their arms. It?s a better bit than I can do justice by describing, but it works.

The pre-school story continued hysterically Cam and Mitch explaining why gay men don?t mix with gay women. The child who harmed Lily?s parents turned out to be lesbians. The scene in the house was pretty hysterical as the two couple did their best to get along. As the kids went missing, Cam hilariously stated how the two couples learned to get along with the half of the lesbian couple he wasn?t getting along with.

Lily?s first day in kindergarten is marred by a hair-pulling boy. Cam gets mama-bear syndrome and picks the boy up to verbally reprimand him. To the principal?s office they go ? to meet the boy?s lesbian parents. The two sets of parents don?t get along ? it?s physics: gay men and gay women don?t get along (Mitchell and Cam provided a demonstration to illustrate the reasons). The principal demands the two sets of parents agree to a playdate.

The plot thread even had an emotional beat towards the end when Haley calls her parents during their drive home upon realizing just how little she fits in on the first day, and the scene really punctuated the madcap nature of the scenes that preceded it. Learning to let go is a universal theme, even if saying goodbye at college move-in day isn?t a universal experience.

This episode was a hoot! I truly loved the touching moments with laughs along the way. My farewell sendoff to college did not contain any tears ? did yours? Did you enjoy Haley?s goodbye to Luke and Alex? Did this episode make you feel old? Was Jay/Gloria a little obnoxious in class? Are you going to preorder ?Phil?s-osopy?? ?Modern Family? does what they do best when they have their characters acknowledge flaws and embrace them in their own individual ways, and those moments read more realistic than having a character make a big, bold choice or have some huge revelation every week. The show takes baby-steps, and that pun was intentional.

Ray Charles Songs Lawsuit Could Make Major Impact On Copyright ...

In a battle over rights to Ray Charles' famous songs, the charitable foundation that was bequeathed the singer's money and assets is suddenly in a tough spot, in danger of losing the substantial revenues that "I Got a Woman," "A Fool for You," "Mary Ann" and other hits generate each year.

That's because Charles' children, who largely were cut out of the will, are attempting to terminate a copyright grant on the songs to Warner/Chappell Music. If the songs reverted to the children, then the Ray Charles Foundation no longer would get royalty checks.

In late March, facing this potential loss, the foundation sued the children, seeking a declaration that the termination notices are invalid. To make this argument, the estate argued that Charles' songs were made under employment to a record label and music publisher. As such, these songs are allegedly works made for hire, "authored" by the predecessor to Warner/Chappell, and the children have no termination rights.

But if that's really true, shouldn't it be Warner/Chappell suing Charles' children?

In late September, a judge arrived at the same conclusion but left the door slightly ajar to a lawsuit if the songs were not made for hire.

So, rather incredibly, the Ray Charles Foundation switched positions this month and now is arguing that the songs were not, in fact, made for hire. The litigation could set up the next big court decision on termination rights, a suddenly important part of copyright law that is causing the music industry fits now that artists such as Bob Dylan, Tom Waits and Tom Petty have sent their own notices.

The industry is still awaiting the big ruling on whether song artists do their work under employment conditions that would make them ineligible to terminate rights.

Earlier this year, in a closely watched battle, original Village People singer Victor Willis won a big victory by getting a federal judge to reject publishers' claims that he couldn't regain control over his work. But the judge's decision didn't address the "made for hire" defense because the music publisher he was fighting dropped the claim before the decision came.

Village People's Victor Willis Wins Huge Rights Reversion Case Over 'YMCA'

In the suit brought by the Ray Charles Foundation, the children responded by essentially saying that if it was true that the songs were authored by the music publisher, the foundation didn't have standing to pursue them -- because it held no rights.

The Ray Charles Foundation's reply: Well, we're the ones who benefit from the rights.

On Sept. 25, U.S. District Court Judge Audrey Collins ruled that if "the works were not works made for hire and the foundation were receiving royalties from simple assignments, [then] it would be a 'beneficial owner' in the copyrights and would have standing to assert an infringement claim."

An infringement lawsuit, yes. But the judge was skeptical whether the foundation would have such standing to challenge the terminations. She ordered more briefing on the issue.

In reaction, on Oct. 2, the foundation made the case that Congress has been silent on who has proper standing to challenge terminations. Since the only provision in copyright law about that standing pertains to a copyright-infringement claim, the judge should use it to confer standing to the foundation.

That goes to the latter part of Collins' "if ? then" conditional formulation, but the foundation also needs to show the "if" part -- that the songs are not made as works for hire, meaning it has to backtrack from the original position. Unsurprisingly, the foundation now admits Charles is the author and that he assigned his work.

On Oct. 9, Charles' children -- represented by Marc Toberoff -- submitted a response. Toberoff is the same lawyer attempting to terminate rights to Superman from Warner Bros. Here, he essentially is looking to grab back Charles' songs from Warner/Chappell.

In the response, Toberoff says the express terms of copyright law don't confer standing on a "beneficial owner" to litigate termination disputes. And even if a judge finds some form of implicit standing, Charles' children say the foundation can't amend the lawsuit with factual allegations inconsistent with the original complaint.

"For example," the defendants write, "whereas the initial complaint alleges that the 'musical compositions were composed [by Ray Charles] as an employee of [W/C predecessor] Progressive,' the new complaint would need to state the opposite. Whereas the initial complaint alleges that the songwriters contract merely 'memorialize[d]' the publishing company's ownership of the songs at inception, the new complaint would need to state that the contracts were affirmative copyright grants. ? The list goes on."

The stage is now set for a ruling that could be quite important.

If the judge agrees that the foundation has standing and allows the case to go on, it would set at least some precedent for other royalty recipients -- say, record producers --to challenge termination notices.

And then the judge potentially will address the other prong: whether the Ray Charles songs actually are "made for hire," a topic that's substantially crucial for record labels and music publishers on the receiving end of termination notices. Of course, the foundation now agrees with Charles' children that the songs in dispute are not works for hire. It could end up meaning that Warner/Chappell has to assert itself into the fight lest a ruling come that robs them of songs.

Obviously, other song publishers would be listening closely.

FCC approves AT&T's nationwide 4G band plan ? Mobile - GigaOM

The compromise plan turns a worthless hunk of airwaves into prime cellular real estate, while protecting neighboring satellite radio from interference. AT&T now just needs to consolidate the remaining 2.3 GHz licenses out there so it can build its new LTE network.

AT&T has received the final approval it needs to create a nationwide 4G band for its own private consumption. On Wednesday, the Federal Communications Commission voted 5-0 in favor of Chairman Julius Genachowski?s proposal to turn previously useless 2.3 GHz Wireless Communications Services (WCS) airwaves into a band fit for LTE.

As I?ve?explained in previous posts, the big problem with WCS was the potential interference a high-powered cellular network would wreck upon Sirius XM?s neighboring satellite radio signals. But AT&T and Sirius hashed out a compromise that would turn 10 MHz of the WCS airwaves into a guard bands on either side of Sirius?s spectrum, ensuring that?Ozzy?s Boneyard?and Howard Stern?would remain protected from AT&T terrestrial mobile data signals. AT&T is then left with 20 MHz of spectrum free and clear.

The only remaining obstacle for AT&T is to consolidate the remaining WCS airwaves still owned by other operators. For Ma Bell?s plan to work it effectively has to own the entire spectrum band.

Five things to look for in Tuesday's presidential debate

WASHINGTON (Reuters) - Republican presidential candidate Mitt Romney has seen a surge in opinion polls and voter enthusiasm since his strong debate performance against President Barack Obama on October 3.

With Obama and Romney running neck-and-neck in the polls, much will be at stake in the debate Tuesday at 9 p.m. EDT (0100 Wednesday GMT) in Hempstead, New York.

Here are five things to watch for in the candidates' second of three matchups before the November 6 presidential election:

WILL OBAMA SHOW UP THIS TIME?

Obama's dour, passive performance two weeks ago frustrated many of his liberal supporters. Even Obama himself acknowledged that he was, as he put it, "overly polite."

He will have to show more conviction this time. Aides believe Romney got away with soft-pedaling conservative positions that could alienate moderate voters in the first debate, and they aim to prevent that from happening again.

"There's no doubt he's memorizing more deceptions as he prepares for Tuesday's second debate," Obama campaign manager Jim Messina wrote of Romney in a memo.

Obama could also try to paint Romney as an out-of-touch plutocrat who does not care about the middle class.

Expect Obama to bring up Romney's reluctance to release more than two years of personal tax returns, his career as a private equity executive at Bain Capital, and Romney's disparaging remarks about the "47 percent" of Americans who pay no federal income taxes.

Vice President Joe Biden set the table with an aggressive, sarcastic performance in his debate last week against Republican vice presidential nominee Paul Ryan, but Obama will have to show more gravitas.

"It's up to him to find that happy medium between maybe the bombast of Vice President Biden's personality and the lackluster performance (Obama) gave in the last debate," said Linda Peek Schacht, a former spokeswoman for Democratic President Jimmy Carter.

CAN ROMNEY CONSOLIDATE HIS GAINS?

Conventional wisdom holds that debates generally don't affect the outcome of presidential races.

That may not be the case this year. Romney's strong performance in the first debate wiped out Obama's lead in opinion polls and boosted enthusiasm among the former Massachusetts governor's fellow Republicans. Romney is now viewed as more credible than Obama on many of the economic issues that are paramount to voters.

This time, Romney won't benefit from low expectations.

He will have to show a command of the issues and a sense of empathy with voters who still view him as less likeable than Obama.

In recent weeks, Romney has been weaving personal stories into his stump speech, both his own and those of people he has met on the campaign trail. During last week's debate, Ryan pointed out that the unemployment rate in Biden's hometown of Scranton, Pennsylvania, is now higher than when he and Obama took office in January 2009.

Expect Romney to continue this more personal approach, both as a way to win voters' sympathy and to show solidarity with the hardship that many Americans have experienced since the financial crisis hit in 2008.

"Lofty rhetoric is one thing, but there are some cold, hard truths at the street level. That will be a big component of how this debate goes," a Romney aide said.

WHAT'S IN IT FOR ME?

This debate adds a significant element of uncertainty: actual voters.

Instead of the usual podium-and-moderator format, Obama and Romney will field about a dozen questions directly from undecided voters in a "town hall" setting, moderated by CNN political reporter Candy Crowley.

The format tends to reward candidates such as former President Bill Clinton, who could connect with voters on a personal level. It also could force the candidates to tone down their aggression and explain how their policies would personally help those asking the question.

Neither the aloof Obama nor the stiff Romney is known for having a particularly warm personality.

Obama is seen as more likable than Romney by a wide margin, according to Reuters/Ipsos polling data, but his charisma on the campaign trail may not transfer to the town hall format.

"I think (Obama is) still under the gun. He seems to be better with an audience of thousands when he's giving a speech than he is in the debate format," said American University political science professor James Thurber.

THE LIBYA QUESTION

Foreign policy was expected to be a big advantage for Obama, who can point to the end of the Iraq war, the killing of Osama bin Laden and plans to wind down the unpopular Afghanistan war.

But the death of four Americans during an attack on a diplomatic facility in Libya last month has given Romney a chance to question Obama's leadership.

The administration's account of the incident has shifted over the past several weeks, and there are questions about whether security concerns were ignored.

Biden may have created an opening last week when he said the administration did not know the diplomatic compound had asked for more security, contradicting the testimony of two State Department officials the day before. The White House has distanced itself from Biden's remark.

Romney initially was criticized for politicizing the incident, but he has stepped up his attacks on the campaign trail.

Expect Obama to point out that Romney's fellow Republicans in Congress have backed deep spending cuts that would likely lead to less money for diplomatic security. Romney could counter by saying the administration has wasted money in other areas that could have been redirected toward security spending.

THE FUTURE

At a time when 23 million Americans are either unemployed, underemployed, or out of the work force, neither candidate has offered more than a vague outline of the steps they would take to boost economic growth and employment.

Obama has offered few new ideas since the Republican-led House of Representatives rejected a package of infrastructure spending and state aid a year ago, while Romney has yet to fully explain how he would manage to cut taxes without adding to the deficit.

The job-creation goals they have outlined are very modest. Romney's promised 12 million new jobs are likely to materialize on their own if the economy grows as projected, while Obama's promised new jobs in manufacturing and natural gas likewise are projected to materialize without government help.

The town hall format could force Obama and Romney to explain in greater detail what they would do to goose the economy beyond the sluggish path that forecasters foresee in the years to come.

"I think you will find that sometimes citizens are better at pushing for specifics than maybe a moderator would be," Peek Schacht said.

(AP) ? The captain of the cruise ship that crashed into an Italian reef appeared in court Monday to hear the evidence against him, while passengers who survived the deadly shipwreck and the families of those who died showed up just "to look him in the eye."

The case of Francesco Schettino, 51, was of such interest that a theater had to be turned into a courtroom in the Tuscan city of Grosseto to accommodate those who had a legitimate claim to be at the closed-door hearing.

Wearing dark glasses and a suit, Schettino used a back entrance to slip into the theater, making no comment to reporters outside. Lawyers said he listened intently to the proceedings, where his attorneys raised some objections to the evidence being submitted.

Thirty-two people died after Schettino, in a stunt, took his Costa Concordia cruise ship off course and brought it close to the Tuscan island of Giglio on the night of Jan 13. The ship then ran aground and capsized. Schettino himself became a lightning rod for international distain for having left the ship before everyone was evacuated.

Hearings this week will help decide whether the judge will order a trial for Schettino, who is accused of manslaughter, causing the shipwreck and abandoning ship while passengers and crew were still aboard. He denies the accusations and hasn't been charged. Any trial is unlikely to begin before next year.

Crash survivors, victims' relatives and their lawyers attended the hearing on the evidence against Schettino and eight others accused in the shipwreck, including crew members and officials from Concordia owner Costa Crociere SpA.

"We want to look him in the eye to see how he will react to the accusations," said German survivor Michael Liessen, 50, who was attending with his wife.

A key question is how much of the blame should Schettino himself bear, and how much responsibility for the disaster lies with his crew and employer, Costa Crociere, a division of the Miami-based Carnival Corp.

Last month, court-appointed experts delivered a 270-page report of what went wrong that night based on an analysis of data recorders, ship communications equipment, testimony and other evidence.

The experts, who included two admirals and two engineers, laid most of the blame for the collision with the reef and the botched evacuation on Schettino. But they also noted that not all crew members understood Italian, not all had current safety and evacuation certifications, and not all passengers had had the chance to participate in evacuation drills.

Schettino's lawyers had sought to have the captain's Indonesian helmsman attend the hearing, but Judge Valeria Montesarchio turned down the request.

Nevertheless, a member of Schettino's defense team, Francesco Pepe, seemed confident, saying during a break in the proceedings that "responsibilities that aren't all Schettino's are beginning to emerge."

While the experts' findings heavily faulted Schettino and some of the other crew, lawyers for some survivors and families of the victims are seeking to point blame at the corporate level, alleging negligence.

Among them is Peter Ronai, a lawyer for the family of a Hungarian violinist who, survivors recounted, gave his life vest to a child before perishing himself.

"The reason people died was not the captain" alone, Ronai told reporters before entering the hearing. "There was no reason for anyone to die."

Passengers have recounted scenes of chaos during the disaster, with the lights going out after the initial collision, plates and glasses smashing to the ground and crew members giving conflicting, confusing directions.

"The ship was as big as a shopping mall, there was dark, there was absolute chaos, men were pushing women away, children in the back," Ronai said. He said the reason people died was because the corporation was "negligent in practices and safety procedures."

Costa Crociere has denied that it was negligent and has distanced itself from Schettino, firing him in July although he is fighting to get his job back.

Passengers have described a delayed evacuation, with many of the lifeboats stuck and unable to be lowered because the boat was listing too far to one side. Some of the 4,200 people aboard jumped into the Mediterranean and swam to Giglio, while others had to be plucked from the ship by rescue helicopters hours after the collision.

Schettino has insisted that by guiding the stricken ship into shallower waters near Giglio's port instead of immediately ordering an evacuation he potentially saved lives. He has claimed that another official, not he, was at the helm when the ship struck.

The timeline in the experts' report, however, makes clear that he had assumed command six minutes before the ship struck the reef.

An American lawyer representing more than 150 people in U.S.-based lawsuits against Carnival Corp. said he came from Mississippi to closely follow evidence that could be useful in his cases. Aside from financial compensation for his clients, John Arthur Eaves Jr. said he is pushing for improved standards in the cruise industry.

"There is a consistent pattern of lack of discipline ... and communication problems," he told reporters. "This accident will happen again."

"The sooner we can resolve it, the sooner these victims can get back to rebuilding their lives," Eaves added.

Explore Life Lah!: Singapore - Staycation at Capri by Fraser

Duration?of Stay : 5 - 7 Oct 2012

A vacation, for many in Singapore, means hopping on a plane, coach or cruise to get out of our reclaimed shoreline to some faraway land. But that definition is set to change with the rise of an oasis in the eastern coast of?our tiny red?dot.?Holiday bliss now?caresses?closer to home.

At the heart of this micro paradise is Capri by Fraser, a hotel-residence seamlessly integrated with an eco-concept mall known as Changi City Point. I had the privilege to be invited for a 3D2N staycation at the?resitel and I was so mighty impressed on so many levels, this will be one megamassivehugebigcolossalmammothenormousgigantictremendouslyextensive blog entry to capture all the things that make Capri by Fraser a choice development for an in-country escapade and a stay above the rest for business travellers.

Changi City : An Oasis in the East

Call me sua ku (mountain tortoise) but before the staycation, I had no idea something called Changi City has sprouted on our eastern soil. Other than Changi Airport and the massive convention halls of Singapore Expo, I hardly come to this area and used to?think it is?somewhat of the boondocks with scarce housing and lots of industrial parks.

But the mini city approach to jazz up Changi has shaped it into a lifestyle destination with much to offer. I would even say it is tourist-worthy even though it's away from the central cluster of tourism hotspots like Orchard Road, Marina Bay, Chinatown, Sentosa, etc. Then again, Singapore is so small and transportation so convenient, far is never far enough.

Capri by Fraser Hotel Residences : Smart, Stylish & Sensational

Introducing?a new?accomodation concept?to Singapore's?hospitality landscape, Capri by Fraser cleverly fuses the comforts of home with the amenities of a hotel and the conveniences of serviced residences. Though not new to the world, this hybrid hotel-residence?brainwave is the first-of-its-kind here.

So, what makes a resitel? Typically, besides rooms, a hotel of good standing would have various amenities such as various F&B outlets, gym, pool, meeting rooms, banquet halls, etc. Residences (a.k.a. serviced apartments) on the other hand, would have lesser amenities but come with in-room kitchenettes and self-service laundromats within the building.

Also, period of stay for serviced residences is usually above a week whereas a hotel would accommodate a night's lodging. Hence, a resitel is an accomodation?arrangement that contains all of the above facilities?with stay duration ranging from one night to as long as you are legally allowed to stay!

More Dirty Laundry Please

It may sound strange, but?the defining highlight of staying at Capri by Fraser has to do with smelly clothes. Mum does my stinky laundry at home but if washing used wearables is anything close to the Spin & Dry rooms funhouses at Capri, she could save on the smelling salts.

When staying here,?you MUST definitely check out the Spin & Dry laundry rooms even if you can tahan wearing the same set of clothes for?two or more days (I'm guilty of that sometimes, that's why mum needs salt revival).

I'm an advocate for?hydro-conservation... less laundry =?less water used. But there's no need for a dirty reason to enjoy the Spin & Dry rooms which come equipped with 'toys' to occupy the time while your second skins have their spa time.

With Xbox Kinect, foosball, punching bag, TRX Trainer, iPads, and Cicollette, the Spin & Play?launderettes are definitely what set Capri by Fraser apart from other serviced residences and reasons not to leave the resitel.

Artify the Senses

Apart from tech muscle, Capri by Fraser?has got the looks to?complement the?smarts. Featuring contemporary?sculptures and?installations from seven international artists to explore the theme of 'Movement and Connectivity' between today's travellers, my?camera went on overdrive to?fill its memory card.

From the reception to the communal spaces to the room to the restaurants right down to the cutleries used and even something as little as the resitel's?pen, art and style breathes through every wall, corner and knick-knack.

Dine?in Style

Having seen the art and serviced residence side of Capri by Fraser, now let's check out the facilities that also make it a hotel... multiple F&B outlets and a suite of relaxation treats.

I didn't get to try the?food at the resitel (other than breakfast)?but it seems that?western cuisines?are its specialty. There's a cafe-deli type set-up known as 'Delite', the main restaurant called 'Caprilicious', and the 'Drinx'?open bar.

Destination Relaxation ?

It is usually rare to find that hotel or serviced residence to offer a full range of pampering treats. If there's a steamroom, a sauna is usually missing. If there's a pool, the gym would usually be miserably equipped, and?that's hoping the pool is more than just a wading puddle.

At Capri by Fraser, there are so many facilities that are well-conceived and working properly that?the body is subjected to relaxation abuse. I was greedy, I tried everything all at one go (except spa massage).

Changi City Point : Factory Outlet Haven

Acting as an extension to the wholistic staycation experience at Capri by Fraser is the attached access to Changi City Point mall. It was my first visit to the shopping complex and I think it is an attraction all unto itself with a beautiful roof garden, outdoor waterpark and a generous collection of factory outlet stores for reputable brands.

A Great Stay for Business or Leisure

If you made it this far with this long post, you would see why I totally enjoyed my stay at Capri by Fraser. Although the hotel-residence is conceptualised and built for tech-savvy business travellers in mind, I think it is one of the best places for a weekend vacation?getaway for locals. Room rates are reasonable too with non-peak prices starting from S$230 per night.

Capri by Fraser will have its official launch in early?2012. To celebrate its soft launch, the resitel is offering a great?3 nights' stay?for the price of 2 (Stay 3 / Pay 2 promotion) till 6 Jan 2013! Don't miss it!
